Queuecut Rider Terms And Conditions
Welcome to Queuecut Pte Ltd website.
We are a food ordering app that connect merchant with consumer for placing their food orders. Our app is available for dine-in, takeaways & island-wide delivery with no minimum order required.
Please read our terms & condition carefully. By accessing & use of our website and app services, you have agreed to acknowledge and be bound by these Terms of Use.
This agreement is entered into between Queuecut Pte Ltd (“Company”) having registered office address at 28 Sin Ming Lane #05-145 Midview City Singapore 573972 and Rider (“Contractor”).
1. Nature of Agreement
Contractor is to act as an independent contractor to perform delivery services for the Company and agrees to ensure the completeness of the services offer and accepted in Queuecut app. The service agreement entered into by the contractor with the Company will be defined as “contract for services” under the Singapore law. The contractor is not entitled to any employee benefits given to the Company employees including all employee’s compensation, leave benefits, disability insurance and etc.
2. Relationship of parties
Contractor is an independent contractor who perform services for the Company and is not authorized to act on behalf of the Company and enter into any agreement with any third-party provider. The company does not hold any responsibilities to fulfill and perform any contract and agreement that entered between the contractor and any third party if any.
3. Use of Queuecut Platform and Account
Contractor is required to register for a Queuecut account and Stripe account (the Company third-party payment gateway) before he can use our platform. During registration, contractor will have to provide his personal information including a valid email address, a mobile phone number and a unique password. Please refer to Stripe terms of use before registering to its payment gateway. Its terms of use can be found at https://stripe.com/en-sg/privacy
The Company shall reserve the right to suspend or terminate contractor account should the Company suspect any misuse of account other than the contractor, fraudulent act and breach of its terms of use, privacy policy and its policies and guidelines.
4. Intellectual Property
All content, logos, material, application, software and others available in the Company website and app platform are strictly belong to the Company ownership and third party who authorized the Company to use them. These rights are strictly reserved. Contractor may not modify, copy, reproduce, republish them for his own personal, commercial or non-commercial use without the Company consent.
5. Cancellation of Job Delivery
Job cancellation button is available in the Company app should contractor wish to cancel after job acceptance. However, please note that job cancellation may affect the contractor incentive should his incentive acceptance level falls below the minimum grading of 4.7. In the event if the cancellation button option is not available, then contractor has to call the customer service to complete the cancellation process.
6. Failure to Complete / Fulfill Job Delivery
Failure to fulfill and complete the services without proper cancellation protocol will affect the contractor’s incentives payout being deducted or penalty in terms of monetary values or issuance of warning letter. This shall be assessed by the company on case to case basis depending on the situation or scenarios.
7. Compensation and Reimbursement
The company is liable for services fees performed by the contractor which will be compensated and reimbursed on a per job basis in SGD currency that is reflected in Queuecut app and do not reimburse any other fee except for those fees or expenses that the Company has approved in advance in writing. The contractor shall take full responsibility for all the taxes, disability insurance and other payroll related cost or taxes while performing services for the Company.
8. Payment Methods
A third-party payment gateway “Stripe” will help to process and accepting payment in Queuecut app and contractor will receive their services fees in their bank account 7 days after each service is completed. The contractor is required to register a Stripe account in order for them to receive their payment from Stripe.
9. Incentives
Contractor incentives reflected in Queuecut app will be differ from time to time depending on the contractor incentives grading and the Company promotion period and marketing plan. The Company reserves the right to withdraw, amend and alter the incentives promotions at any time without prior notice as it deemed necessary.
10. Attire
Contractor is required to wear the Company uniform at all times during his services performance.
11. Confidential Information & Protection of Company Information
Contractor shall not disclose disclose to any third party any confidential information obtained during contractor’s performance of the Services. Confidential information shall include and is not limited to trade secrets, business plans, strategies, financial information and any other information that will affect the Company competitive position. Contractor has obligations to maintain confidentiality and secrecy shall apply until such time that the information is no longer confidential or has been made public by the Company. Contractor shall not without prior written consent of the company destroy, make copies, duplicate or reproduce in any form of the Company confidential information. Contractor also agrees to refrain from posting any negative comments of the Company via any social media or online.
12. Personal Data And Information Protection
Contractor agree and consent to allow the Company to use, collect, process and disclose Contractor personal data and information in accordance with these Terms and as described in our Privacy Policy. Contractor may refer to the Company privacy policy in its website at https://queuecut.sg/privacypolicy/
13. Uploading Material To Queuecut Site And its Service
Any photos, images & materials that contractor uploaded in the Company website and platform and any data the Company collected are considered non-confidential & non-proprietary. Contractor acknowledge and agree that the Company have the right to use, copy, distribute, sell and disclose to third parties any such material or data for any purpose related to the Company business.
Photos and images uploaded are for references only and it may differ from actual goods.
14. Third Party Link and Websites
Should the Company website or platform contain any link to other sites and resources provided by third parties, it will be for Contractor information only. The Company does not have any right or control over the content on these sites or resources and shall not be bear any responsibility for them or for any loss or damage that may arise from the Contractor use of them.
15. Jurisdiction And Applicable Law
The Company terms and condition and the use of the Company website and platform shall be governed by the laws of Singapore without regard to its conflicts of laws principles.
16. Variations
The Company may revise its terms and conditions at any point of time by amending this page. Contractor is required to check this page from time to time to be aware of the changes the Company make which may be binding on the Contractor.
